The College"},"content":{"rendered":"<p>An applicant who was not offered admission\u00a0by the Admissions Committee has brought a discrimination lawsuit against The College and argues that:<\/p>\n<p>a) The College offered admission to racial minorities\u00a0who had lower academic qualifications than the plaintiff, a white student.<\/p>\n<p>and<\/p>\n<p>b) The plaintiff&#8217;s constitutional rights under the Equal Protection Clause of the 14th Amendment were violated because The College treated\u00a0him differently than other applicants based on their\u00a0race.<\/p>\n<p><strong>Persuasive essay assignment:<\/strong><br \/>\nFor the final round of this simulation, each member of the\u00a0seminar will be randomly assigned to a legal team, which\u00a0may not necessarily represent your personal view. You\u00a0must research and write an amicus curiae (&#8220;friend of the court&#8221;) persuasive essay that is consistent with\u00a0your assigned role. You are encouraged to coordinate your research and arguments inside your legal team, and to discuss your ideas with anyone, but your writing must be your own work.<\/p>\n<p>Team 1: <a href=\"https:\/\/www.cir-usa.org\/\">Center for Individual Rights<\/a>: advocates for color-blind admissions<\/p>\n<p>Team 2: <a href=\"http:\/\/www.naacpldf.org\/\">NAACP Legal Defense Fund<\/a>: advocates for color-conscious admissions<\/p>\n<p>Team 3: <a href=\"http:\/\/www.tcf.org\/experts\/detail\/richard-d.-kahlenberg\">Richard Kahlenberg<\/a>, The Century Foundation: advocate for class-based affirmative action<\/p>\n<p>Team 4: <a href=\"https:\/\/www.law.georgetown.edu\/faculty\/cashin-sheryll-d.cfm\">Sheryll Cashin<\/a>, Georgetown University: advocate for place-based affirmative action<\/p>\n<p>Your\u00a0persuasive essay may not exceed 1500 words (including references) and will evaluated by your peers and the instructors based on\u00a0these criteria:<\/p>\n<p>1) Does the author present a clear and focused thesis statement in the introduction? Does\u00a0it state a position in favor of the plaintiff, the defendant, or neither party, and why? Does it state what kind of admissions policy and practices The College should use to create an entering class?<\/p>\n<p>2) Is the author\u2019s reasoning persuasive and well developed?\u00a0 Are the claims supported with appropriate evidence?\u00a0 Are counter-arguments fully considered?<\/p>\n<p>3) Is the essay well organized with smooth transitions between focused paragraphs?
